Notice of Change in Adversary Proceeding Summons Distribution - Judge Kelley Cases |

Effective immediately, in Judge Kelley’s cases, if an adversary proceeding is filed electronically, Chambers will no longer mail an informational memo and paper summons to the plaintiff’s counsel for service. An electronic copy of the Summons and optional Certificate of Service will be docketed and served electronically on the plaintiff’s counsel. The “Summons Issued” docket entry will include text to note the plaintiff’s obligation to make service. To confirm service you may complete and file the Certificate issued with the Summons, use your own form, or use the fillable .pdf form on this website under Bankruptcy Forms “Local Forms.”

Important Notice Regarding Time Period Changes Effective December 1, 2009,
Including 14-Day Deadlines for Filing Schedules, Statements, Chapter 13 Plans, and
Bankruptcy Appellate Briefs Among the time-computation amendments to the Federal Rules of Bankruptcy Procedure that
will take effect on December 1, 2009, are changes to 12 rules that will result in a reduction by one day
(from 15 to 14 days) of the time to take action. The affected rules are Bankruptcy Rules 1007, 1019,
1020, 2015, 2015.1, 2016, 3015, 4001, 4002, 6004, 6007, and 8009. Please take note of these changes
and particularly of the new 14-day deadline for filing schedules, statements, and other documents under
Rule 1007(c); for filing a chapter 13 plan under Rule 3015(b); and for filing appellate briefs under Rule
8009(a). To the extent local rules deadlines conflict with the Federal Rules of Bankruptcy Procedure, the federal rules control. Our new local rules, which should be in place shortly, do conform to the new federal rules.
Reaffirmation Agreement Cover Sheet - Official Form 27.
Rule 4008 is amended, effective December 1, 2009, to require the filing of a cover sheet to accompany the reaffirmation agreement. The cover sheet, new
Official Form 27, collects financial information for the court to determine whether a reaffirmation agreement creates a presumption of undue hardship, pursuant to 11
U.S.C. § 524(m), and whether such presumption has been rebutted. The form also requires disclosure and explanation of any differences between the income and
expenses on Schedules I and J versus the income and expenses reported in the reaffirmation agreement.
Official Form 1, Exhibit D.
Exhibit D, Individual’s Statement of Compliance with Credit Counseling Requirement, is amended at Statement 3 to incorporate the new seven-day window
for the exigent circumstances exception to the pre-filing credit counseling requirement. See 11 U.S.C. § 109(h)(3)(A)(ii), as amended by Pub. L. 111-16,effective December 1, 2009. The amended form also reflects the deadline change from 15 to 14 days for filing a copy of a certificate and debt repayment plan, if any. See Fed. R. Bankr. P. 1007(c), as amended effective December 1, 2009.

Search Fees, Certifications, Exemplifications, Reproduction of Audio Recordings, List of Unclaimed Funds, and Record Retrievals. To utilize this service, please contact the Clerk's Office at (414) 297-3291, and ask for a receipt writer. A valid credit card is required to take advantage of this service.

Proposed Amended Local Rules |

Pursuant to 28 U.S. C. § 2077, the Chief Judge appointed a Local Bankruptcy Court Rules and Procedures Review Committee to study the Court's local rules and to propose amendments to them. You can find a copy of the committee's proposed changes to the local rules at: http://www.wieb.uscourts.gov/docs/Local Rules - DRAFT 10-20-09.pdf Pursuant to 28 U.S. C. § 2071, the Court welcomes public comments regarding these proposed changes. Written comments should be posted on the Bankruptcy Insolvency and Creditor's Rights (BICR) listserv. This allows comments to be viewed by all practitioners as well as members of the local rules committee.
The public is invited to appear and comment at a hearing on the proposed changes to the local rules. Speakers may be subject to a time limitation.

Privacy Rule Reminder |
|
Privacy Rule Reminder: To protect the rights of debtors and creditors, Bankruptcy Rule 9037 requires that certain personal data identifiers be modified or redacted from Bankruptcy Court case files. While there are limited exceptions, only the following should appear in filings made with the Bankruptcy Court:
- only the last four digits of an individual's social security number or taxpayer identification number - only the last four digits of a financial account number - only the year of an individual's birth - only the initials of a minor.
Please note it is the responsibility of the attorney or the party making the filing with the court to redact the personal information. The clerk will not review documents and remove personal information. Special rules apply for transcripts that are filed with the Court. See the Transcripts tab of this website for more information. Consult Bankruptcy Rule 9037 for exemptions from the redaction requirements. If you or another party in a case has filed personal identifiers, you may file a Motion to Restrict Viewing of that document to court staff only. Please contact us with questions about the Privacy Rule. |

Pro Se Help Desk, Thursdays, 9:00 a.m. to 10:30 a.m., U.S. Courthouse, Room 133B. Please Note: The Help Desk will be closed on the following Thursdays:November 26, 2009, December 24, 2009 and December 31, 2009.We need volunteer attorneys for the Pro Se Help Desk and attorneys who may be willing to accept referrals of Chapter 13 debtors. If you are an attorney, and you wish to volunteer or add your name to the referral list, please contact the Clerk's Office at (414) 297-3291, extension 3204. The bankruptcy section of the Milwaukee Bar Association, with the assistance and support of the State Bar of Wisconsin, provides a Pro Se Bankruptcy Help Desk at the United States Bankruptcy Court in Milwaukee. The service is provided on a first come, first served basis. Due to increased volume, it is possible that if you do not come early you may not be seen. There will be a sign-in form outside room 133B and each person will be called in turn. The service is available to chapter 7 debtors (or people considering filing chapter 7 bankruptcy) who wish to proceed pro se (i.e., do not have a lawyer to represent them in a bankruptcy case). The service provides assistance with completing the required bankruptcy paperwork. |
