1 The clerk's office will only send notice of the motion, not the motion itself or any accompanying document, unless the motion and notice are combined into one document, e.g., “Motion and Notice of Motion to Dismiss for failure to attend §341 meeting.” Where the motion and notice cannot be combined into a single, short document, the trustees must docket notices separately from motions to ensure that the clerk's office sends notice to all parties. A trustee may contact the clerk's office if an unusual circumstance occurs to request that a notice to be sent on his/her behalf, e.g., “Notice of Motion to Pay Interim Compensation.” The clerk’s office cannot send notices to all creditors unless a provision of the Bankruptcy Code or Rules requires that notice be given to all creditors.
